expensive than phase 1 but it 's five years down the road so, inflation will
probably take care of the rest of it. Phase 3 though the costs are pretty
close to twice the cost of either on of these phases ubt I didn' t
see where there was a great deal of need to have Nottingham submit bond on
phase 3 when he isn' t even going to touch it for 10 years and at that time, we
could adjust the bond accordingly.
RW: do they agree to that
MH: Yeah,
RW: So that $7000 is just for phase 1 and 2 right now
RW: Okay, you heard the staff recommendation any questions of Mark with respect
to the application? Then I refere to get it on the floor I would move approval
of the Nottingham S b G File 78-352 with the bond set at $7000 and with the
stipulation that this bond. . .
LH: I have all the language if you want, Dr. Ward.
RW: OK,
LH: Wnat me to read it in the records?
RW: That is what I 've got with the addcitional statement that Mark read into the
record, about phase 3
RW: regarding phase 3 and the reconsideration of the bond, I second
RW: Ok, now
RT: Ok, I jsut have a quick one on that address thing so that when you' re by a
landowner, is it going to be corrected in the Board so there's not a
foulup on the taxes so she' s not paying the property taxes , I mean that 's a
minor thing but we might as well take each of one of these objections.
RW: Ok, Mr. Kerd
K: Can I speak from HEre?
RW: Sure, if you speak loudly enough, there' s no problem, our recording devices area
here so
K: First off, I 'd like to apologize, I did'nt realize that I conducted my remarks
toward the wrong caxe, I wasn' t given any case number or anything like that
RW: No problem
K: But Rio Grande RR would like to recommend that this application not be approved
Our main problem si with access to this subject mining proposed properties this
is a priva to crossing and never has been a public crossing and when they first
proposed I thin- it was the Brush Creek and the Eagle River Co. started some
mining operations down there they were the predecessor to Nottingham or Nottingham
was involved I don' t know exactly the legal technicality, but htey started
using our crossing without our permission this crossing wasn' t built to accommodate
these heavily laden trucks to cross that cross, at this particular crossing
and I would liekto emphasize also there's not just one track here there are two
tracks there's our main line tracks that ' s parallel by a passing track this particular
area has a speed limit of about 40 miles an hour we had our poeple go out there and
check and they estimate that visibility for an engineer is about 1/3 of a mile
as it comes around the curve in that particular area. Now if one our of our
trains was approaching this crossing and one of these trucks wasy trying to
get across this particular crossing we could throw on our brakse our air, and
we'd never stop in time there could be a serious accident and I think this one
thing that you gentlemen should consider is the impact that say that derailment
