iy
I 'm not familiar with that - you know
RW: Ok, would you speak to your next question.
g: There are some other problems as far as the NPDES - there' s an assertion that
there will be no discharge of surface waters - I understand that the in
contract between the 2 Nottingham and Brush Creek that there was an easement
for Eagle River Discharge surface water discharge into the Eagle River obtained.
and whether or not that is contemplated in the near future or whatever there is
once obtained and it indicates there there may be an NPDES problem. In addition,
to their recent changes in their NPDES permits which require permits if the water
will affect wells and these I believe settling ponds that they' re contemplating
here - maybe the water that' s washing the gravel whatever, maybe settling down int
the water table which may then go into adjacent wells and there may be an NPDES
problem there. Ther are some other problems which may exist , there are propane
distribution centers, commercial distribution centers nearby, nearer than the
airport which haven ' t been indicated on the application. and I don' t know if a
problem with any of that might be but the application is incomplete in that
respect. There is a contemplated cement and asphalt plant contempalted in this
area which is a rangeland area, these people who have recently purchased the
land, the Eagle River . .
RW: Before you go through with that , We just went thru that and said that there is no
permission, for them to construct that kind of facility.
G: I just wanted to make the Board aware that when in this order it might be a
little more difficult at some later date to say that once you have this gravel
operation going, that we' re going to, we' re not going to permit this cement and
asphalt plant, and that we have landowners here who are going to who are very
concerned at this point , that there may be some problem there, and something
may be developing which could seriously prejudice their proerty interests.
And we just would like to talk, with whatever your procedures requirem that means
not issuing an order at this date, objecting to the applicator, postponing
it , something so that we can review this and have some time to review this matter.
and then present to you some evidence if it exists if it doesn' t fine, our objection
would then be withheld.
RW: Mark
MH: On the asphalt plants , let me just read you what it says. Potential location for
concrete and asphalt plants are shown on the mining map, Exhibit C.
However, the operator has no further plans for eithe r type of operation. At
some point in the future, it may become desirable to extend the site activities,
to include one or both of these operations. They may however be undertaken by
someone other than Nottingham S b G CO. In the event that Nottingham itself should-
wish to put an asphalt or concrete plant into operation , plans will be submitted
to the Board for approval and any necessary permits will be obtained. I
assume you have to go to the County to get approval on that too.
BN: We already have approval from the county.
MH: You do.
G: I understand that there is some machinery, '. is this there some cement plant or
some structures on location at this point in time?
?: Are the being used?
