The Pennittee, Oldcastle SW Group, Inc. dba United Companies of Mesa Courts desires to <br />conduct a mining operation ]mown as BLM Pit No. 1, for the purpose of e~rtraeting sand and gravel. The <br />Pennittee will not mine any secondary commodities at this site. <br />B. On January 11, 2002 the Mined Land Reclamation Board (the "Board") approved the <br />Pernrittee's application for this permit, fixed the amount of the financial warranty and drredeci that this permit be <br />issued upon the Sling with the Division of Minerals and Geology (the "Ihvision'~ of perfornlance warranty and <br />financial warranty (or warranties) in the amount so Exed in form and substance approved by the Division. Said <br />warranties have been Sled with the Division. <br />C. If the Pemrittee desires to extras materials other than those listed in (A), a separate permit may <br />be required. <br />D. On January 11, 2002 the Board made the following Endings: <br />1. The application for this pemvt complies with the requirements of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Carstrudion Materials, C.RS. 34-32.5-101 et sue., as amended, and <br />with all apphcable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />permanent man-made structure located wither two hundred feet of the Affected Land, except where there is an <br />agreement between the Operator and the persons having an interest in the structure that damage to the structure is <br />to be compensated for by the Pemuttee; and; <br />
