Long <br />Division Dveclor <br />The Division received a letter from Diane and Thane Anderson requesting that the Mined Land <br />Reclamation Board (NLRB) reconsider approval of the 112 Permit Application for the Tellier <br />Gravel Pit, Pern3it No. M-98-058. The NLRB approved the 112 Permit Application, submitted <br />by Johnson Excavating, at the December 16, 1998 Board Hearing. The letter is enclosed for <br />your reference. <br />The letter was submitted [o the NLRB in accordance with Rule 2.9 of the Construction Material <br />fa Rules and Regulations regarding reconsideration of Board decisions. The letter was received by <br />~, the Division within ten (] 0) working days of the receipt of the Board's v<Titten decision. <br /> <br />According to Rule 2.9.3, the Board may grant or deny the petition based solely on the written <br />submittal, or the Boazd may, in its discretion, grant the Petitioner an opportunity to present oral <br />arguments. <br />The Division will present the Anderson's petition to the Board at the January 25-26 Board <br />Hearing as a discussion item.
