ISSUES <br />Presentations to the Board shall be limited to the following issues. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. (The issue numbers shown in parenthesis aze taken from the <br />April 21, 2006 Rationale for Recommendation.) <br />Is the information submitted with the application accurate and complete for the following <br />items (Rule 1.4.1(3): <br />a. the pre-mining land use and site description (Issue 4., 6. and 16.); and <br />b. the plat map (Issue 20.). <br />2. Has the Applicant accurately indicated the projected amount from each of the sources of <br />water to supply the project water requirements? (Rule 6.4.7(4)) (Issue 8.) <br />3. Will areas outside of the affected land be protected from slides or damage (including <br />flooding) occurring during mining operation and reclamation? (34-32.5-116 (4)(i)) <br />(Issues 9. and 20.) <br />4. Is the geotechnical stability exhibit adequate to address potential off-site impacts to the <br />cliff face and to the underground workings? (Rule 6.5) (Issues 11. and 12.) <br />5. Has the Applicant described how potential impacts to the prevailing hydrologic balance <br />of the Carbon Irrigation ditch will be minimized? (Rule 3.1.6) (Issue 21.) <br />[V. WITNESSES AND EXHIBITS <br />Pursuant to Construction Materials Rule 2.6(2), all parties must exchange witness and exhibits <br />information as set forth below at the Pre-hearing conference. At the pre-hearing conference, the <br />parties agreed to exchange witness and exhibit lists by close of business on May 2, 2006. <br />Parties must make a list identifying all witnesses that each may call to testify during the hearing. <br />Identify each witness by name, address, phone number, azea of expertise (if any) and subject(s) of <br />proposed testimony. You are not obligated to call every witness on your list. However, if you <br />fail to identify a potential witness, that witness' testimony may be excluded on that basis. <br />
