RESPONSI$ILITIES 5 Modi`~cacion Suspension or Revocation of Pe^nits By the Division (Continued) (d) At the request of the permitcee, the Division may modify, or terminate a certification if the following conditions are met: (i) In the case of termination, the permietee notifies the Division of its intent co terminate the certification 90 aays prior co the desired dace of termination; (ii) In the case of termination, the permittee has ceased any and all discharges to state avatars and demonstrates to the Division there is no probability of further uncontrolled discharge(s) which may affect waters of the State. (iii) The Regional Aaministrator has Seen no cified of the proposed modification or termination and does not object in wri*_ing within thirty (30) days of receinc of notification; (iv) The Division finds that the permitcee has shown reasonable grounds consistent with the Federal and State statutes and regulations for such modification, amendment or cerninacion; (v) Fee requirements of Section 5.16.0 of State Discharge , Permit System Regulations have been met; and (vi) Requirements of public notice have been met. 6 Oil and Hazardous Substance Liability Nothing in this permit shall be construed to preclude the inst`_tution of any legal action or relieve the permittee from an•r responsibil'_cies, liabilities, or penalties to which the oeraittae is or may be subject co under Section 311 (Oi'_ and Hazardous Substance Liability) of the Clean `dater Act. 7.
