_ ° United States Department of the Interior u.°~ ~~~
'i;
ti Bureau of Land Management
Gunnison Field Office
A ':, +'~ 216 North Colorado
Gunnison, Colorado 81230
July 11, 2003
p~ived
MEMORANDUM "~~
To: file; COC-61223 ~q ~
From: Realty Specialist ~~~~
Subject: Compliance Examination; Right-of--Way Serial Number COC-61223 "~Y
On July 3, 2003, I visited the subject right-of--way for purposes of conducting a
compliance examination. Mr. Wayne Giesy, President of Ophir-Nevada Inc., and
Mr. Reid Giesy were present.
Mr. Giesy requested that the bridge, which they had originally been installed by
them across Henson Creek, be removed from that location on public land to be
used on their own property. I approved this request.
Mr. Giesy also requested that the common rock material, known as "dump rock"
which was the result of excavation that had occurred on their private property, be
utilized for placement upon the access road. This material had been examined by
Mr. Bob Oswald, geologist with the Colorado Division of Minerals and Geology,
and consequently the material was determined to be suitable for such purposes as
road fill. I concurred with the assessment of Mr. Oswald and subsequently
approved the request to use the material on the access road.
In my inspection of the access road right-of--way I found the work accomplished by
the right-of--way Holders to be exceptionally conscientious in terms of protecting
the site from unnecessary impacts. Mr. Wayne Giesy and Mr. Reid Giesy had
refrained from using any heavy equipment to improve the road, choosing instead to
accomplish the work by hand using only hand tools. This, in my opinion is rather
extraordinary considering that most of the work required moving a large quantity
of boulder and talus material in various locations along the road. The work
accomplished would have been very arduous. I would also point out that Wayne
and Reid have also been extremely gracious to work with and anxious to ensure
that the right-of--way is being managed fully in compliance with all the terms,
