ProjectsC29-09 VACATION OF RIGHT OF WAY, <br />EASEMENTS, AND 11 LOTS, VIRGINIA ACRES <br />SUBDIVISION/ REZONE FROM PLANNED RESIDENTIAL (PR <br />0.4) TO AGRICULTURAL/ FORESTRY TRANSIT"IONAL <br />(AFT)/ CONDITIONAL USE PERMIT - GRAVEL PIT. <br />Petitioner: United Companies of Mesa County, Inc. <br />Location: Virginia Acres Subdivision, South wes~ <br />corner of C-1/2 and 30 Roads. A request to <br />vacate Virginia Acres Subdivision, rezone from Pit <br />0.4 to AFT, and for approval of a conditional use <br />permit for gravel extraction prpcessing on 17.7 <br />acres. Existing easements for pedestrian access, <br />Public Service, and drainage are not to be <br />vacated. <br />b. Surroundino Land Use and Zoning: The project <br />site is in a predominantly AFT-zoned area with <br />the exception of Melody Estates and Willowood <br />Planned Mobile Home Parks to the north on 30 <br />'Road. Along 30 and D Roads are several single <br />family residences. Within one mile of the site <br />four active or recently active gravel pit <br />operations exist. The approved and platted <br />Virginia Acres Subdivision includes one developed <br />lot in the northeast corner, but no other <br />improvements are on site. The plat includes a <br />50-feet wide public pedestrian easement along the <br />Colorado River. <br />c. Stafif Comments: Virginia Acres Subdivision is a <br />platted Planned Residential development which has <br />never been improved. After receiving extensions <br />to the original improvements agreement, approved <br />in 1980, the agreement lapsed in 1907. In the <br />approval of the subdivision :Mesa County accepted <br />a 6.5-acre parcel on the Colorado River as open <br />space. This parcel includes a lake, which is an <br />old gravel pit, and marshy riparian vegetation. <br />This area is identifiied in the Colorado Corridor <br />River Inventory as bald eagle and blue heron <br />habitat as well as a major riparian, aquatic, and <br />waterfowl area. The petitioner proposes to <br />partially fill the lake and wetlands with <br />overburden from the gravel operation to enhance <br />the area. This action will require a 404 permit <br />from the Army Corps of Engineers. The benefiit of <br />the existing lake and important wildlifie habitat <br />
