Canany <br />Acring Division Director <br />Listed below are adequacy review comments for the Two Rivers Pit 112 Permit Amendment Application, File <br />No. M-2002-052. The Division of Minerals and Geology ("Division") is required to make an approval or denial <br />decision no later than July 31, 2002, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />Rule 6.4.3 Exhibit C- Pre-minine and Mining Plan Map(s) of Affected Lands <br />Exhibit C is defined as the Pre-mining and Mining Plan Map(s) of Affected Lands. During the <br />pre-mining inspection, access onto the permit area was via a roadway entering from the <br />northwest. The current permit application does not depict the road on the pre-mining map, and <br />there are no specifications in the reclamation plan that the road will remain. Please indicate the <br />location of the access roadway on the pre-mining, mining, and reclamation maps. Also please <br />specify in the reclamation plan, that the access road will remain after reclamation of the site. <br />Rule 6.4.4 Exhibit D-Mine Plan <br />2. The site was infested with Scotch Thistle at the time of [he pre-mining inspection. The <br />reclamation plan indicates that weed control will be incorporated upon reclamation of the site. <br />Weed control may be necessary during the mining process. Please indicate what methods will be <br />incorporated to control weeds at the site during mining activity at the site. <br />Rule 6.4.8 Exhibit H- Wildlife Information <br />3. Exhibit H is defined as Wildlife Information. According to the permit application, the wildlife <br />survey conducted by Savage and Savage indicated that portions of the site serve as potential <br />habitat for Preble's meadow jumping mouse and Ute ladies'- tresses orchid, both identified <br />species of special concem. According to 34-32.5-1 I S (4) (d) of [he Colorado Revised Statues, the <br />operator must comply with laws or regulations of this S[a[e or of the United Slates in order to <br />receive a reclamation permit from the Division of Minerals and Geology. In that this proposed <br />operation will potentially affect the habitat of species of special concem, the applicant must <br />receive a permit from the U.S. Fish and Wildlife Service relative to this disturbance.
