Execuo~e Dueaor <br />Henderson, CO 80640 Michael B. tong <br /> Division D~reclor <br />RE: Technical Adequacy Review of 110 Application for Permit No. #M-99-089, Weathers Mine #1 <br />Dear Mr. Weathers, <br />This letter is being written to address technical issues which must be resolved before the Division of <br />Minerals and Geology (DMG) can approve the application submitted by your company for Technical <br />Revision 001, Permit No. #M-99-089, Weathers Mine #1. Please address the following concern prior to <br />the due date of September l6, 1999: <br />1) Exhibit C -Mining plan -The 15' setback from the permit line specified on p. 8 does not leave <br />enough maneuvering room for the average bulldozer, especially if this pit is to be mined at 3H:1 V, or <br />if 3H:1 V slopes are [o be established (as specified) after the initial excavation. Please increase the <br />setback to a more realistic working corridor. <br />2) On p. 10, Exhibit D, Reclamation Plan, it is stated that should there be a change to the seed mix, <br />DMG will be informed. Such changes to the reclamation plan require a Technical Revision to the <br />permit. It is also stated that the depth of mining may increase, depending on the size of the deposit. <br />Please commit to submitting technical revisions, should such changes to the permit become necessary. <br />Please be advised that this permit application may be deemed inadequate, and your application may be <br />denied on September 16, 1999, unless this adequacy item is addressed to the satisfaction of the Division. <br />If you have any further questions, please feel free to contact me at (303) 866-3567. <br />Sincerely, <br />Christina L.
