Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below aze adequacy review comments for the Heit Sand and Gravel 112(c) Permit Application, File No. M-2003-016. <br />The Division of Minerals and Geology ("Division") is required to make a recommendation no later than July 3, 2003, <br />therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please subnut the proof of publication of the public notice circulated in the local <br />newspaper and all owners of record of surface lands, and easement holders that aze on the affected land and within 200 <br />feet of the boundary of the affected land. Proof of notiee may be return receipts o€ a Certified Mailing or by proof of <br />personal service. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other qualified person. <br />The maps submitted to the Division were not signed. Please resubmit a signed copy of the maps. <br />Rule 6.4.4 Exhibit D-Mining Plan <br />3. Section (a) of the Mining Plan requires the Operator/Applicant to supply a description of the method(s) of mining to be <br />employed in each state of the operation as related to any surface disturbance on affected lands. The applicant states that <br />processing plants will be located in the center of Mine Area 1. Please describe how the facilities will be managed to <br />ensure groundwater and surface water will not be impacted. Please describe the nature and storage locafion for all <br />hazazdous waste [hat will be used on site. <br />4. Please describe all haul roads that will be utilized for the mining opemtion. Rule 6.3.3(g) requires the applicant to <br />specify the dimensions of any existing or proposed roads that will be used for the mining operaton. Any improvements <br />necessary on existing roads and the specifications to be used in the constmction of the new roads needs to be described <br />in the permit and included as part of the pemutted acreage. The applicant will also need to address reclamaton of any <br />new or improved roads constructed on site. <br />5. The topsoil will need to be segregated and stored separately from the overburden material as required by Rule 3.1.9(1). <br />Please revise the reaps to depict the location of the topsoil piles and the overburden piles. <br />6. The applicant notes that during Phase I of the operation, excavation of dewatering trenches, sedimentation ponds and <br />sump azeas will occur. Please provide additional detail regazding the construction, use and management of these <br />structures and include them on the Mine Plan Map, Exhibit C-3. What will happen to these structures during <br />reclamaton? <br />7. The applicant states that during earthmoving operations, grubbed vegetation will be stockpiled for later use in <br />reclamation. Please be awaze that woody vegetation does not meet the criteria of "inert material" as described by Rule <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
