This plan was submitted on behalf of Elam Construction, Inc. (Elam), and <br />received by the Department on May 14, 2003. The Department has some minor comments on the plan, <br />which are attached. It is my understanding that these comments will be incorporated into the ftnal plan <br />to be submitted to the Division of Minerals and Geology (DMG). <br />The azea to be mined for gravel lies in the southern portion of the Fruita Refinery, which is owned by <br />Fruita Marketing and Management, Inc., (FMM), and is currently subject to the requirements of <br />Compliance Order No. 98-06-OS-O1. The May 2003 application represents a revised version to address <br />the concerns identified in the DMG's preliminary adequacy review (dated January 2, 2003) of the <br />October 2002 application. Many of DMG's concerns were related to soil and groundwater <br />contamination issues in the area to be mined. In early 2003, the Department coordinated meetings with <br />a number of agencies, including the DMG, the Water Quality Control Division, and the Colorado <br />Division of Wildlife, and FMM, Elam, and their consultant (Greg Lewicki and Associates).
