However, the Board did approve, with the Division's <br />recommendation, that the Division continue to support Pueblo Coal's efforts to <br />renew the permit until July 25, 1991. This letter, therefore, is to advise <br />Pueblo Coal of the major issues that still require action before the Division <br />can recommend in favor of permit renewal: <br />1. Designs for permanent stream channel, diversions, and collection channels <br />associated with the excess spoil disposal area that meet 100-year, <br />24-hour storm event criteria pursuant to Rules 4.09.1(5) and 4.09.2(7). <br />(Reference Mined Land Reclamation Division letter to Pioneer Engineering <br />dated January 4, 1991 ). <br />2. Demonstration of right of entry pursuant to Rule 2.03.6(1) and <br />Section 110(2)(j) of the Act. <br />3. Replacement bond of $1,125,300. <br />All other major issues have been addressed and upon satisfactory <br />these remaining actions, the Division will recommend to the Board <br />reconsider its decision to deny the permit renewal application. <br />minor issues identified in the January 10, 1989, adequacy review <br />7, 8, 10, 11, 12, 13, 17, 18, 19, 20, 21, 22, 23, and 24) should <br />prior to July 25, 1991 as well.
