be taken to make sure this occurs without spills. Should a spill accidentally oceur, <br />the proper procedures will be followed to protect against pollution, <br />17. Please identify and name all ditches on and within 200 feet of the affected land. <br />Please locate these ditches on the appropriate maps and further explain the ownership of <br />the ditches. If any ditches are to carry water or are relocated as a result of the mining <br />operation, please submit a written consent from the owner of the ditch. <br />There are no ditches within 200 feet o f the area <br />18. The Division received comments from the Office of the State Engineer (OSE). The <br />OSE states that the applicant has not identified any proposed use of water at the permit <br />site. If water will be used for any purpose at the site, the applicant will need to document <br />that the water was obtained from a legal source, or the water was diverted in priority <br />under a water right decreed for such industrial use. <br />No water will be utilized in this mining operatiou. <br />19. The OSE letter also states that if stonnwater runoff is intercepted by this operation <br />and is not diverted or captured in priority, it must be released to the stream system within <br />72 hours. This may require a permit from the CDPIIE-WQCD. Otherwise, the <br />application will seed to make replacements for evaporation Please address accordingly. <br />The soat6 side of the actively mined area will be protected with temporary erosion <br />fabric. This will allow any water runoff to be slowed down and released at a rate <br />which will impede any water erosion. The temporary erosion fabric does allow the <br />runoff to slowly leave the site, releasing well before the 72 hour period mentioned. <br />Rule 6.4.9 Exhibit I -Soils Information <br />20. The applicant provided a soils map in the permit application. Please indicate on the <br />soils map the location of the proposed Schumacher Pit #3. The location is important in <br />order to determine the soil type and characteristics. <br />A copy of the soils map showing the pit location is attached. <br />Rule 6.4.12 Exhibit L -Reclamation Costs <br />21. The Division will estimate a cost to reclaim the site based on the information <br />submitted in the application. <br />Reclamation costs are of vital interests to this pit owner and all other pit owners of <br />northeast Colorado. The Division's cost estimate needs to reflect equipment and <br />labor prices for this area of the state, not the moantains or front-range. I will be <br />happy to discuss this issue farther with Carl Moant, if we cannot agree on a <br />reasonable estimate for oar area <br />6 <br />
