' ~.
Robert Carlson Page 2
October 28, 1986
year. Since the South Platte River is already over-appropriated, this will
result in a loss of water to downstream irrigators.
The app]icant states that this evaporation will be replaced by augmenting with
water provided from 125 inches of water of appropriation no. 25 running in the
canal of the Consolidated Hillsboro Ditch Company. No information was pro-
vided concerning the effective yield and historic use of this water. The
applicant also did not discuss the dry-up of any irrigated lands. An augmen-
tation plan must be developed, submitted to, and approved by the Water Court.
We have no record of this being done.
Unless a plan for augmentation is developed to replace the water loss to the
system due to evaporation, the operation will injure existing water rights.
Therefore, we cannot recommend approval of the permit until the applicant is
capable of mitigating the injury that will be caused by the project. Further,
we will order Coulson Excavating Co. to cease operations if our Water Commis-
sioner determines ground water is being exposed without a well permit or there
is determined to be a wasteful use of ground water occurring.
HDS/JCM:ma/8726H
cc: Alan Berryman, Div. Eng.
