Subsequent to receiving the public notice and formally <br />reviewing the application at the Clerk and Recorders office of Ga~eld County, the City of Rifle <br />requested and received a copy of the application from Balaz & Associates. This provided staff <br />and City Council an opportunity to review and comment on the application. It is the purpose of <br />this letter to formally make you aware of the City's concerns regarding this proposed activity. <br />As this proposed activity lies between Interstate 70 and the Colorado River and lies at the <br />entrance to the City of Rifle, staff and council have the following concerns to express: <br />That the application will be thoroughly processed and reviewed as to the activity's <br />potential impact on a variety of environmental issues. We anticipate the following permits <br />will be required as a condition prior to any approvals from the Division of Minerals and <br />Geology: <br />a. M.L.R.B. mining and reclamation permit. <br />b. Garfield County special use permit. <br />c. Garfield County Floodplain special use permit. <br />d. City of Rifle watershed permit. <br />e. N.P. D. E.S. permit through the Colorado Department of Public Health and <br />Environment (C.D.P.H.E.). <br />f. U.S. Army Corps of Engineers 404 permit. <br />a. C.D.P. H. E. 401 Certification <br />h. Compliance with Section 7 of the Endangered Species Act <br />i. Fugitive dust notification. <br />j. F.A.A. notice and approval relative to waterfowl hazards that may be realized as <br />a result of activity created lakes and the close proximity to the Garfield County <br />Aiport. <br />k. Water augmentation plan for lake evaporation and water consumption. <br />2. That the Floodplain/floodway impacts are thoroughly evaluated. Concern is expressed as <br />the proposed activity lies within the Floodplain and floodway of the Colorado River. <br />Various other similar activities in the Colorado River Valley have actually changed the <br />geologic character of the Colorado River and changed its normal course of flow. This <br />has created the need for local agencies to expend money and effort to revise andlor <br />enact additional mitigation measures necessary to protect river crossings and other <br />development that may be negatively impacted by changes in the geological character of <br />the Colorado River. The application will need to assure that mitigation efforts are <br />performed such that periodic flooding of the "developed lakes" (even from ordinary high <br />
