M~~nael s. tong <br />Division Director <br />Englewood, CO 801 I I <br />RE: New Application Consideration Date, Final Consideration, Parkdale Project, File No. M•97-054 <br />Dear Mr. Albert: <br />Thank you for your letter dated October 7, 1447 and received by fax October B, 1997. <br />You have requested a 30 day extension of time to prepare responses to the Division's application adequacy review letter. <br />The November 10, 1997 date you have requested is approved. Please have your responses in our office by that date or <br />request another extension and a new application consideration date. <br />In your letter, the latest date you asked for consideration of your application is the January 1998 Board meeting. That <br />meeting is tentatively scheduled for January 28 - 29, 1998. The Board has not voted on the schedule for their 1998 <br />meetings, but these are the normal dates. Your new application consideration date is set, at your request, for January 29, <br />[998. <br />Please be aware that Rule 1.4.5(3) slates that "the date set for consideration of the application may be extended, pursuant to <br />Section 1.8, if the Applicant changes the application. Such date shall not be extended (by [he Division) beyond ninety (90) <br />days after the last amended filing." Your response to the Division's adequacy letter, because of the volume and complexity <br />of information requested, will undoubtedly be considered an amended filing of your application. <br />Once the Division determines that the review can be completed, a recommendation made to the Mined Land Reclamation <br />Board, aPre-Hearing Conference held and all statutory notice procedures met, we will schedule your application for a <br />hearing and final decision at the earliest possible date. The hearing will be scheduled within 90 days of your amended <br />filing. We will try to meet the schedule you have suggested for a December hearing, if possible.
