(c) Provisions for monitorin¢ the structure durine and after modification or reconstruction to <br />ensure that the performance standards of these Rules are met; and <br />(d) A showine that the risk of harm to the environment or to public health or safety is not <br />sianiticant durine the period of modification or reconstruction. <br />RESPONSE <br />Middle Creek Office <br />The Middle Creek Office, located in Section 13, Township ~ North, Range 86 West, is the only existing <br />strucuue within the proposed permit area. A disturbance of approximately 1.7 acres is associated with the <br />metal construction structure and adjoining parking lot. The building was constructed in 1978 as an <br />office/shophvarehouse complex for the Middle Creek Underground Mine. A schematic diagram of die <br />facility is presented in Figure 3, Mine Office Plans. <br />The area surrounding [he Middle Creek Office has been approved for storage of non-coal wastes; i.e. <br />salvageable and surplus mining equipment as well as any other material or equipment not in use by the <br />mining operation. Toxic ,hazardous, radioactive, or petroleum product wastes will not be stored on [his <br />site. <br />Runoff from the site is temporarily detained by a compacted earthen berm constructed around the parking <br />area, thereby maximizing percolation and minimizing overland flow onto adjacent land. It is planned to <br />maintain the building and parking area after reclamation to augment postmining land use. The approved <br />postmining land use of pastureland requires that buildings be available for administrative and maintenance <br />• use resulting from the ranching operation.
