ISSUES TO BE CONSIDERED <br />Presentations to the Board shall be strictly limited to the issue of whether the pending application <br />complies with the requirements of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Sections 34-32.5-101 et sec .., C.R.S. (1999) ("Construction Materials <br />Act") and the rules and regulations promulgated by the Board. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />The effect of the proposed operation on Mr. Davis' irrigation and domestic water wells. <br />2. Concern that the site will be used for water storage with [he ability to create stagnant <br />water. <br />3. Flood control down river from the proposed operation. <br />4. Effects from the aggregate removal on the course of the river. <br />5. Methods of how the azea will be reclaimed. <br />
