We have reviewed the biological assessment which accompanied your <br />request for consultation, and are providing this biological opinion as <br />prescribed by Section 7 Interagency Cooperation Regulations (50 CFR 402) and <br />the Endangered Species Act (ESA) (16 USC 1531 et seq.). This document is <br />being provided to you as lead agency for the ESA Section 7 consultation <br />pertaining to this proposed project. ~ <br />BIOLOGICAL OPINION <br />The construction and operation of the SKM, with the inclusion of conservation <br />measures designed to aid in the conservation of the Colorado squawfish <br />(Ptychocheilus lucius), humpback chub (Gila cypha), and bonytail chub (Gila <br />elegans), is not likely to jeopardize the continued existence of these <br />federally listed fishes. Additionally, the SRM project is not likely to <br />jeopardize the continued existence of the bald eagle (Haliaeetus <br />leucocephalus); construction commitments to avoid disturbances to potential <br />roost trees will offset adverse impacts to this species. We concur with the <br />finding in your biological assessment of "no effect" for the peregrine falcon <br />(Falco peregrinus). <br /> <br />~(~~C L ~e <br />
