In <br />answer to your questions about the access road to the quarry and the letter from the Marble Historical Society <br />(MHS), let me state several points. <br />1. The new permit application includes a different permit boundary location, specifically, the exclusion of the <br />formerly permitted access road. The choice to exclude the road was the applicant's. At the present time no <br />decision has been made by this office regarding that chosen exclusion, since we are presently in the application <br />review period. 1 have not "allowed" this exclusion, nor made a decision on any other part of the application yet. <br />2. The underlying landowner of the access road is OMYA, Inc., and has leased this land to the applicant. A <br />letter from OMYA is included with the application stating that OMYA, as landowner, wishes far the road to remain <br />(a copy of that letter is attached for your information). The road is pre-existing, and as such was not constructed for <br />the proposed operation. Additionally, the applicant has indicated that no substantial upgrading or new road <br />construction will be undertaken. Given these factors, it appears that the existing road will not be required to be <br />included in the permitted area, pursuant to CRS 34-32.5-103(1) and Construction Materials Rule 1.1(3). <br />3. The letter from Betty [sic] Lou Gilbert of MHS, as you state, contains no language related to the access <br />road. I do not know if that letter is related to the applicant's choice to excltide the road, as described in the <br />submitted application, though it seems to have bearing on his overall reclamation plan. As you requested, I have <br />attached a copy of the page from the new application which includes the MHS letter.
