points out, if the data indicate an ambient quality with a concentration in excess of the WQCC
groundwater standard for a particular parameter, the numeric protection level is set at the ambient
quality. So, if erroneous completion of a monitoring well or wells is responsible for readings
which indicate high concentrations of metals, American Soda would be granted inappropriately
lax standards.
Finally, if the results are anomalous after granting the permit, there will be a tendency to
make da with the existing data by malting sense of it in some way, and so maintain American
5oda's project schedule. This is not a circumstance that will occur if the statute and Rules are
followed, and all permit conditions are established in advance ofgranting the application.
Respectfully submitted this 18"' day of7une, 1999.
GENERAL CHEMICAL CORPORATION
riy: ~ _
Of: Rothgerber Johnson & Lyons LLP
2424 Pioneer Avenue, Suite 210
P.O. ]3ox 808
Cheyenne, WY 82003-0808
Telephone: (307) 638-6262
Facsimile: (307) 638-6565
E-mail: amiruer(~worldnet.att.net
Attorneys for General Chemical Corporation
10
