<br />Bucklen Equipment Company <br />USR-513:82:23 <br />OPERATION STANDARDS <br />1 The uses permitted on this site shall include the extraction of sand and <br />gravel material as described in the application materials on file with the <br />Department of Planning Services. <br />2. No excavation or processing of materials shall be permitted nearer than ten <br />(10) feet to the boundary of adjacent property, easement or irrigation <br />ditch or right-of-way, nor nearer than 125 feet to any existing residence, <br />unless by written agreement to the owner or owners of such adjacent property <br />consent to a lesser distance and the Commission approves such lesser distance. <br />3. The road in the southwest corner of phase five (5) leading to northwest "C" <br />Street shall not be used to haul sand and gravel material. <br />4. All extraction operations shall be conducted during the hours of daylight, <br />except in cases of public or private emergency, or to make necessary repairs <br />to equipment. This restriction shal]. not apply to the operation of administra- <br />tive and executive offices or repair facilities if located on the property. <br />5. The Use by Special Review area shall be maintained in such a manner so as <br />to prevent soil erosion, fugitive dust and growth of noxious weeds. The <br />site shall be maintained in such a manner as to present a neat and well <br />kept appearance. <br />6., Insurance - The operator shall furnish evidence they are insured to the <br />extent of not less than $100,000.00 against liability for any negligent act <br />or omission by the operator from the operation, maintenance, extraction, <br />and/or production of the sand and gravel and shall include all activities <br />connected with or incidental thereto. <br />7. The slope on the gravel pit bank shall be a minimum ration of five (5) to <br />one (1) as requested by the Soil Conversation Service. <br />8. An air emmissionc permit shall be obtained from the Colorado Department of <br />Health, Air Pollution Control Division, for the mining activity. <br />9. Noise Standards as specified in Section 25-12-103 of the Colorado Revised <br />Statues 1973, as amended, must be maintained. <br />10. A National Pollution Discharge Emmission System permit is required to <br />discharge waste water to waters of the State. <br />11. No stockpiling shall be allowed in the Use by Special Review area which <br />would as a result alter the historic drainage pattern causing damage to the <br />adjacent properties or County road right-of-ways. <br />12. The request shall comply with the operation policies of Section 44.4 of the <br />Weld County Zoning Ordinance. <br />13. Operations Standards for Uses by Special Review, Section 24.6 et. seq. of <br />the Weld County Zoning Ordinance shall be complied with. <br />14. The Use by Special Review shall be limited to the plans shown hereon and <br />governed by the Standards stated above and all applicable Weld County <br />Regulations. Any material deviations from the plans and/or Standards, as <br />shocm or stated above, shall require the approval of an amendment of the <br />Permit by the ]field County Planning Commission before such changes from the <br />plans and/or Standards are permitted. Any other changes shall be filed in <br />the office of the Department of Planning Services. <br />15. The property owner and/or operator of this operai.on shall be responsible <br />for complying with all of the above statea Standards.
