ivHEREAS, on April 14 1980 T. M. RUSSELL & R. C. BARGER "FILED" an
zpplication,a reclamation clan and map, and the required fee, as required by 1a:a; and
G1Y.ERE.~,S, on May 29 1980 the `lined Land 3eclamation 3oard approved
T. M. RUSSELL & R. C. BARGER application and set bocd; and
W!iEREdS, on October i 1980 the Mined Lard Reclamation Board accepted
surety submitted by T. M. RUSSELL & R. C. BARGER and such date sha11 be considered the
date of issuance of the perait and the anniversary date for all other purposes; and
idHERE~S, the }fined Land Reclamation Board has made a finding, for the purposes
of issuing *_his Hermit, that:
1) the application complies with the recuirements of the Colorado
".iced Land Reclamation yct and all applicable local, state and
Federal laws;. znd,
2) the operation will not advarseiy affect the stability of any
significant, valuable, ar.d permanent man-made structures located
within two hundred fee*_ of the affected land, except where there
is ar. agreenent between the operator and the persons ha~~ing an
interest in the structure that damage to the structure is to be
compensated for by the operator; and,
3) tae eroposed mining operations and reclamation can be carried out
is conforctance with the recuirements of C.R.S. 19i3, 34-s2-Ii6, as
anended 11976 Sess. Laws H.3. 1065); and

satisfactory showing to the 3oard that he will employ duri^.2 and after his
