STATE OF COLORADO RIC HnRO ~MM, Govc~~nr III III III III IIII III
DEPARTMENT OF NATURAL RESOURCES
D. Monte Pascoe, Executive Director
MINED LAND RECLAMATION
423 Centennial Building, 1313 Sherman Street
Denver. Colorado 80203 Tel. (303) 839-3567
David C. Shelton
Director
Mr. Paul Sale
Road and Bridge Dept. Supervisor
P.O. Box 426
Norwood, Colorado 81423
RE: 14 San Miguel is
Our file No 81-154, 1-214 through 81-226
~~ .
Dear Mr. Sale:

Enclosed please find a copy of a letter from Mr. Jeff Walter, a land-
owner evidently adjacent to the Norwood Pit, file ~~81-154. Please
clarify the situation as regards possible gravel removal by San Miguel
County from his land. If the operation extends onto his land, the
acreage disturbed on his land should be part of the permit area, or a
separate application Tray be submitted if the two areas are not contiguous.
Since this pit area is already to be 9.5 acres, any addition over about
0.49 acres would make this a 112 permit application, requiring a separate
permit application. I suggest you contact Mr. Walter at your earliest
convenience.
You may notice that new file numbers have been assigned to Pits 2 through
14. The new file numbers (in increasing numerical order) correspond to
the individual pits in the same sequence as given in your submissions for
Pits 2 through 14.
Mr, Walter included a copy of your publication in his letter to me. I
noticed that the legal descriptions of each of the 14 pits had not been
given. Rule 3.22(2)(b). requires that each proposed operation be iden-
tified to ..section, township and range and street address, where ap-
plicable." This will necessitate re-publication for two consecutive
weeks, as well as the re-notification of all landowners and adjacent
landowners (as per Rule 3.22(3)). I am sorry about this misunderstanding,
but the Rules and Regulations are unequivocal in this matter. This will
most probably also necessitate your requesting a further continuance
until the November 18-19, 1981 Board meeting.
I am also awaiting your reply to my adequacy letter of September 4th.
If there are any problems with this reply or anything else in this letter
please call me.
t-' ( e
Sincerely, ~> /
~L~e ~ tl)I ~~l~I_
Mark S.
