<br /> <br />notice thereof to Burkett, and thereafter, Corn shall not be <br />obligated to pay any additional advance royalties. Corn shall <br />then vacate the premises with reasonable dispatch and this Lease <br />Agreement shall terminate subject to the obligations for recla- <br />mation as contained hereinafter. For the purposes hereof, <br />"mined out" shall be defined as the removal from the premises of <br />the mineable commercial sand and gravel. <br />7. Corn shall save Burkett harmless from all taxes which <br />may be assessed or levied against the property installed by Corn <br />on the leased premises or against any increase in ad valorem <br />taxes caused solely by the conduct of sand and gravel operations <br />on the leased premises. All such taxes shall be paid before the <br />same become delinquent. <br />8. Burkett warrants title to the leased premises and to <br />the sand and gravel located thereon and hereby agrees to indem- <br />nify and defend Corn from any adverse claims whatsoever. <br />9. At the ?xpiration of the lease term, or prier thereto <br />if the gravel has been mined out, or the expiration of any ex- <br />tension hereto which Corn may exercise as provied above, Corn <br />shall complete the reclamation of the property at Corn's sole <br />expense in accordance with the terms of the permits issued by <br />Mesa County, Colorado and Colorado Mined Land Reclamation <br />Board. <br />10. Corn agrees that at all times during the term of this <br />Lease or any extension thereof, it shall keep Workman`s Compen- <br />sation Insurance in full force and effect. In addition, Corn <br />covenants that it shall indemnify Burkett against any claim or <br />demand for personal injury or oroperty damage and further cove- <br />nants that Corn is covered by insurance for not less than <br />$300,000 for personal injury and $50,000 for property damage and <br />an umbrella coverage for at least $1,000,000. <br />11. Prompt payment of the amounts herein agreed upon to be <br />paid by Corn and compliance with all terms and conditions herein <br />expressed, is of the essence of this Agreement, and if Corn <br />- 4 - <br />
