LEASE AGREEMENT <br />THIS LEASE AGREEMENT is made and executed this .?_ day <br />of /~_,_,. _ ^, 1962, by and between KENNETH D. BURKETT and <br />WANDA N. BURKETT, whose address for purposes of this Agreement <br />is 624 Curtis Street, DeBeque, Colorado, hereinafter referred to <br />as "Burkett", and CORN CONSTRUCTION CO., a Colorado Corporation, <br />whose address for purposes of this Agreement is P. O. Box 1240, <br />Grand Junction, Colorado 81502, hereinafter referred to as <br />"Corn", WITNESSETH: <br />WHEREAS, Burkett is the owner of the following described <br />real property in Mesa County, Colorado, to-wit: <br />That part of the SE1j4 SE 1J4, Section 28, <br />Township 8S, Range 97W, 6th P.M. lying South <br />and East of the Colorado River. <br />WHEREAS, the said property contains sand and gravel and the <br />parties desire to lease the premises to Corn for the purpose of <br />the estrac*_ion thereof; <br />NOW, THEREFORE, IT IS AGREED: <br />1. Burkett hereby grants unto Corn the exclusive posses- <br />Sion of the property described above for the purpose of extract- <br />ing, crushing, and stockpiling sand and gravel. <br />2. Corn shall have the right to install machinery, equip- <br />ment, personal property, telephone lines, electric lines and <br />water lines in and on the leased premises and shall have the <br />right to remove such property from the premises at the end of <br />the lease term. <br />3. Corn shall proceed with due diligence to apply for a <br />permit from Mesa County, Colorado, to use the above premises for <br />the above purposes and, upon granting thereof, shall proceed <br />with due diligence to apply for a permit from the Colorado Mined <br />Land Reclamation Board and for a "404" permit. If any of those <br />permits shall be denied, then this Agreement shall terminate and <br />be of no further force or effect. This Lease shall become <br />effective upon the date when the last of the said permits shall <br />issue. <br />
