O. ~ <br />Box 1240, Grand Junction, Colorado 81502, hereinafter referred <br />to as "Corn," WITNESSETH: <br />WHEREAS, Lathams are the owners of the following des- <br />cribed real property in Mesa County, Colorado, to-wit: <br />All that part of the following described property <br />lying North and West of the Larkin Ditch in Township <br />8 South, Range 97 West of the 6th Principal Meridian, <br />to-wit: <br />SW;SW; in Section 27, <br />N'~NE;NE4 in Section 33, <br />NW;NWi in Section 39, and <br />N'~SE;SWq in Section 27, lying West of Highways 6 and 24; <br />and <br />WHEREAS, the said property contains sand and gravel and <br />the parties desire to lease the premises to Corn for the purpose <br />of the extraction thereof; <br />NOW, THEREFORE, IT IS AGREED: <br />1. Lathams hereby grant unto Corn the exclusive poses- <br />Sion of the property described above for the purpose of extracting, <br />crushing, and stockpiling sand and gravel and the installation <br />and operation of an asphalt hot mix plant and concrete batch plant. <br />2. Corn shall have the right to install machinery, equip- <br />ment, personal property, telephone lines, electric lines and <br />water lines in and on the leased premises and shall have the <br />right to remove such property from the premises at the end of <br />the lease term. <br />3. Corn shall proceed with due diligence to apply for a <br />permit from hlesa County, Colorado, to use the above premises <br />for the above purposes and, upon granting thereof, shall proceed <br />with due diligence to apply for a permit from the Colorado Mined <br />Land Reclamation Board and for a 404 permit.
