Cattany <br />Acting Division Director <br />RE: Notice ojReconsideration ojPermit Application, Quarry No.l, File No. M-1991-072 <br />Dear Sir or Madam: <br />On July 24, 1991, The Colorado Mined Land Reclamation Board (NLRB) approved the permit application for <br />Montrose Stone Company, the Quarry No.l Pit (File No. M-1991-072). A permit for the Quarry No.l Pit was <br />never issued because Montrose Stone Company, as the applicant, did not provide the required financial and <br />performance warranties or bond. <br />The Division of Minerals and Geology (DMG) has not issued a permit under C.R.S. 34-32.5-117(1) because <br />the operator has not provided perfonnance and financial warranties, as described in and C.R.S. 34-32.5-117 <br />(2), (3), and (4). Therefore, the DMG must schedule the application for reconsideration under the provision of <br />Rule 4.1 (2) which states, in pazt, "If these warranties are not received within one calendar year of approval of <br />an application for any new permit, amendment or conversion, the Board shall hold a hearing to reconsider the <br />previous approval". This matter has been scheduled before the Mined Land Reclamation Boazd for <br />reconsideration and possible denial o£ this permit application. A formal public hearine will be held at the <br />September 18-19. 2002 Board meeting for xeconsideration of the permit application approval. The hearing <br />will be held in room 318 of the Centennial Building, 1313 Sherman Street, Denver, Colorado, 80203, <br />beginning a[ 10:00 a.m. or as soon thereafter as the matter can be considered. At the hearing you will have the <br />opportunity to be represented and heazd. <br />Alternatively, if you do not wish to contest the reconsideration of the application for the Quarry No.l Pit <br />(File No. M-1991-072), a letter may be provided to the DMG withdrawing the application from <br />consideration.
