The Division requests that you respond [o <br />the comments presented by I) ensuring that your mine plan and existing condition maps include the location(s) of all <br />existing man-made structures (including easements) and by 2) ensuring that compliance with Rule 6.4.19 (or <br />Permanent Man-Made Structures will be achieved (see attached copy of Rule 6.4.19). Please note that the Division <br />will require only require you to address existing structures rather sVUCtures which may be installed in the future. The <br />Division appreciates your cooperation in this matter and requests that you submit a written response to these <br />comment letters on or before June I, 2001. <br />Although none of the three (3) comment letters explicitly state the party is objecting to the application, the Division <br />is preparing to treat them as such. However, the Division has sent letters to each of [he 3 parties requesting a proms, <br />written clarification of whether they are in fact objecting. All 3 parties would need to respond in writing by May 25, <br />2001 and clearly stale they are no[ objecting to the application in order for the Division to be able to make a final <br />decision on your application within 90 days. If any of the 3 panies do not respond in writing or if any of the 3 <br />parties respond by expressing an intent For their comments to be vested as an objection, then the Division will <br />proceed with an informal conference, pre-Hearing Conference, and Formal Public Hearing. The Division will keep <br />you informed as to the date, lime, and location of these various meetings. At this time, we anticipate holding an <br />informal conference during the week of May 28 -June 1, 2001; apre-Hearing ConFerence during the week of June <br />l8 -June 22, 2001; and a Formal Public Hearing at the June 27-28, 2001 Board Meeting. <br />Please contact me al (303) 866-3567 if you have any questions. <br />Sincerely, <br />Thomas A.
