t ~
November 1~1, 1997
RECEIVED
Ms. Levern Lemav
A4inerals Program Assistant to the State of Colorado NQ~ ~ ] 997
Department ofNanual Resources
Division of 1\4inerals &: Geology )ivicion or mmertas & Ge010
1313 Sherman S[., Room 215 9Y
Centennial Building
Dem•er, CO. 80203
RE: Comment on Applicarion for a Construction Dlaterials Regular Operation
(112) Reclamation Permit by Daren Stone, sole proprietor of an enterprise called
Stone Gravel Pit. Proposed pit is located on 158.18 acres located on or near Section
12 R 13, Tier 35 North, Range 17 R%est, New Dlexico (lOd') Principal bferidian.
Dear Ma Lemav
Please let us introduce ourseh•es. \Ve are Ric and Lynda Emerson and our address
is 6066 County Rd. 21. \\%e are on the northeast comer at the intersection of County
Rd. 21 and County Rd. F. This is adjacent and to the cast of the proposed Stone
Gravel Pit.
\Ve request, pursuant to section 2.6.1(1)(b} of the Construction Industry Rules and
Regulations of the Mined Land Reclamation Board (the "Rules"), that we be
notified of the date of the informal conference. We also request, pursuant to Rule
1.-1.6(2), that we be granted party stains and that this comment letter be considered
a "statement of issues" for purpose of the informal conference.
The following is a list of our concerns and complaints about the proposed gravel pit
of 1\4r. Stone's
1. The performance of our well, will probably be jeopardized. bit. Stone has not
stated where his water resources will be coming from.
2. The wildlife habitat in this area would he disrupted. \\%e have recently learned
that this area is a wLtter hunting ground for the Golden Eagle, the Bald Eagle and
the Great IIomed Owl.
3. \Ve have neighbors suffering with asthma, heart problems, as well as one who is
sufferutg from cancer. The dust bowl that would be created would he very-
dangerous to these individuals.
-1. \Ve do no[ feel that County Rd. 21 utd County Rd. F could handle the hearty
tra6ic [hat would he created by the gravel trucks. It is already used by School Busses
and the residents in this area. R'e feel this would become a very dangerous situation
as the road is too narrow to handle both vehicles.
5. The BI.A4 land being proposed for this gravel pit not only has artifacts front the
Anasazi bu[ is used by the community for bike riding, horse back riding, hiking and
the local school for their field day events.
6. R%e are also concerned with the property value. \Ve have been informed b}'
realtors in the area that our homes value would decrease by approximately 50°io..
