That right is not subject to pending litigation. TCC also agrees that: <br />a) No subsurface development or exploration activity will take place on any lands where all or part of the <br />Federal Mineral Estate is not leased (to TCC or any affiliate) without obtaining a Bureau of Land <br />• Management lease, license, or permit; <br />b) Including unleased Federal Minerals within the permit boundary shall not preclude issuance of other <br />Federal permits or leases to prospect, develop, or produce deposits of Federal minerals within the coal <br />mine pemut boundary; and <br />c) For those areas where such right-of--entry has not already been secured, acceptable right-of--entry <br />information will be submitted before mining-related activities commence. Such areas include lands in the <br />SW/4 of the SW/4 of Section 33, T6N, R86W. None of these lands are in the mining area proposed in <br />Pernut Revision PR06-07. <br />1) CONTRACT, dated February 15, 1983 between TCC and GMMI, whereby TCC has all rights to enter and to <br />operate the surface and underground coal mining operations contemplated under this permit revision <br />application. The owner of the fee and/or leasehold interests in the coal and property to be mined, including the <br />surface areas to be disturbed, is the successor by merger to GMMI. <br />2) EQUIPMENT LEASE, of mining equipment and facilities for the underground and related surface operations, <br />between Cyprus Westem Coal Equipment Company and Cyprus Western. These equipment and facilities will <br />be available to TCC under the contract described in (1) for use in the operations. <br />3) CERTIFICATION OF NAME CHANGE, dated December 21, 1981, and August 20, 1982, of the Secretary of <br />State of Colorado certifying the name change of Energy Fuels Corporation to Colorado Yampa Coal <br />Company, and Colorado Yampa Coal Company to Colorado Yampa Leasing Company, respectively. <br />Reference in the description of documents below the Energy Fuels Corporation or Colorado Yampa Coal <br />• Company is therefore to the same entity now called Colorado Yampa Leasing Company, an affliate of TCC. <br />4) DEED AND BILL OF SALE, dated August 31, 1982, wherein Colorado Yampa Leasing Company granted, <br />bargained, sold and delivered unto Getty Coal Company its entire right, title and interest in and to all of its fee <br />and lease surface and mineral interests. <br />PR06-07 2.03-24 11/29/06 <br />
