Actions Taken to Abate Violation: Actions resulting in spill were addressed through immediate conversations with <br />contractor. Ditch was cleaned-out the day after the inspection (August 24, 2006), and a protective berm was <br />established on the far side of the ditch to provide an additional measure of protection from any material that might <br />splash during discharge to the ditch. The contractor cleaned the minor amount of splashed material from the <br />• vegetation adjacent to the ditch by hand. <br />Final Resolution: The NOV was terminated and TCC submitted payment for the $250.00 civil penalty on October <br />10, 2006. <br />Mine Identification - DMG Permit No. C 82-056 ,., <br />MSHA ID No. -05-03836; Issued 1983 <br />Violation Identification: CV -2005-005, May 3, 2005 <br />Issuine Regulatorv Authority: Division of Minerals and Geology <br />Brief Description of Violation: Part 1 -Topsoil not completely removed from disturbed areas of west runoff ditch <br />at 18-Right Ventilation Shaft; Part 2 -Topsoil along 18-Right Access Road not stored in a manner which would <br />protect the topsoil resource from erosion and contamination. -Normal winter snowplowing operations resulted in <br />roadbase materiai being deposited on windrowed topsoil as plowed snow melted in the spring. <br />Date. TCC submitted a request for an Assessment Conference on June 21, 2005, <br />the Assessment Conference was held on July 20, 2005, and the civil penalty was reduced by $ 100.00 (seriousness), <br />based on the conference. The CDMG issued a Settlement Agreement on July 22, 2005. TCC signed and retuned <br />the Settlement Agreement on July 29, 2005. <br />Current Status: Part 1 of NOV terminated on June 13, 2005. Part 2 of NOV terminated on December 14, 2005. <br />Actions Taken to Abate Violation: Part 1 -The remaining minor amount of topsoil was recovered from the crest of <br />the west runoff ditch and placed in stockpile; Part 2 -TCC prepared and submitted Technical Revision TROS-50 on <br />June 7, 2005 to establish topsoil stockpiles in lieu of the existing topsoil windrows and to recover and place the <br />windrowed topsoil in stockpile. The CDMG approved TROS-50 on October 13, 2005. As a result of information provided at the Assessment <br />Conference, Part 1 of the NOV was vacated on July 22, 2005. The CDMG issued a Settlement Agreement on July <br />22, 2005. TCC signed and returned the Settlement Agreement on July 29, 2005. <br />Current Status: Part 1 of NOV vacated on July 22, 2005. Parts 2~ of NOV temminated on August 11, 2005. <br />Actions Taken to Abate Violation: Part 1 - On discovering the problem, TCC had immediately closed the valve on <br />the vent pipe to stop fimrther mine water discharge (prior to May 3, 2005 inspection). Even though this part of the <br />NOV was vacated, TCC subsequently modified the design of the NW Mains Ventilation Shaft SAE to eliminate any <br />reasonable potential for uncontrolled discharge, submitted the revised designs as MROS-194 on June 1Q, 2005, and <br />following CDMG approval of the revised designs on July 21, 2005, reconstructed the SAE. Part 2 -The pump was <br />not operating at the time of the inspection and was removed from its location adjacent to the stream the next day. <br />• The PAP text was revised to include pumps and pumping as ancillary equipment and operations that may be utilized <br />to support ongoing mining and related operations. Parts 3 and 4 -The PAP text was modified under MROS-194 to <br />address both the potential for mine water discharge and compliance with applicable provisions of Rule 4.05.2. <br />PR06-07 2.03-20.1 11/07/06 <br />
