<br />W I T N E S S E T H
<br />~~EREp$,Schmidt-Tiago Construction Co,desires to conduct a(n) open- mining
<br />operation, known'as CHRISTIAN PIT I11 , for the p'urpoee of extradtipg open
<br />mined sand.-' pnd gravel •
<br />WHEREAS, on December 13 19 77 5c idt-Ti o r str "FILED;' an appli-
<br />cation, a reclamation plan and map, and the requiPted-~ee, ~~~d by law; and
<br />WHEREAS, on February 22nd' 19 7t~ the Mined Land Reclamation Board approved
<br />Sclunidt,Tiago Construction Co. app icatiop and set bond; and
<br />WHERe:AS, on February 22 , 19 78 the Mined Land Reclamation Board accepted surety
<br />submitted by Schmidt-Tiago Construction Co. and =uch date shall be considered the
<br />date of issuance of the permit and t~e anniversary date for all other purposes; and
<br />SJHERE?.S, the Hined•Land Reclamation Board has made a find~ag~ for the purposes
<br />of issuing Ehis permit, that:
<br />1) 'the application complies with the requirements of the Colorado
<br />'.-Mined Land Reclamation Act and all applicable local, state and
<br />~. Federal•laws; and,
<br />2) the operation will not adversely affect the stabilicy.of any
<br />significant, valuable, and permanent man-made structures located
<br />within two. hundred fees of the affected land, except where there
<br />is an agreement beraeen the operator and the persons'havSng ar. .
<br />interest in'the structure that damage to the structure is co be
<br />compensated for by the operator; and, '.
<br />3) the proposed.mini.ng operations and reclamation can be carried out .
<br />' in confor~ance with the requiremencs~of C.R.S. 1973, 34-32-I16,••
<br />as amended (1976 Sess. Laws H.B. 1065); and
<br />`+.•HEREAS, for the purposes of issuing this permit, the operator has made' -
