DANIELSON, DEPUTY STATE ENGINEER <br /> SUBJECT: ALBERT FREI & SONS PIT #3 , ADAMS COUNTY, APPLICATION FOR <br /> MINING AND RECLAMATION PERMIT <br /> As requested by your office, we have reviewed the application for a gravel <br /> pit near Commerce City. In Exhibit E, page 3 , the applicant states that <br /> "the owner of the property has wells and Burlington Ditch rights which would <br /> provide water for dust control and for irrigation, if necessary, of the vege- <br /> tated mix planted". Due to lack of information in the application, we cannot <br /> determine the adequacy or decreed use of these water rights. In Exhibit G, <br /> page 1, the applicant proposes using Burlington Ditch shares to augment <br /> evaporation losses from 11 acres of lake surface. The applicant has failed <br /> to consider the actual amount of water available to the shares in dry years , <br /> the historic consumptive use of the shares , and the fact that approximately <br /> 70% of evaporation losses occur during the irrigation season. Until additional <br /> information is provided concerning the dependability and actual amount of <br /> water available to the applicant, we cannot recommend approval of the appli- <br /> cation. <br /> Je is A.
