Dept. of Natural Resource <br />Appropriate personnel from this agency have reviewed the above-referenced <br />application. The mining and reclamation plans seem well conceived and <br />should yield minimal impacts upon wildlife. However, there is a compli- <br />cation which affects this agency. <br />The Division of Wildlife has been granted a permanent recreation easement <br />covering the subject property for the benefit of the state's wildlife <br />resources. No mention is made of this on page 2-- in apparent contradic- <br />tion with page 8; this agency will not relinquish its easement. We did <br />agree to the public access restriction to the actual working area but <br />nothing else. <br />Pages Q 3-3 and Q 3-4: It is unacceptable to this agency that Loveland <br />Excavating have sole and exclusive possession of the subject property. <br />This is in violation of our existing easement. <br />Water augmentation may be a problem. Representatives for the project <br />have stated to us that water will be provided for augmentation of evapor- <br />ation loss after the mining is finished. The application states water <br />will be provided only during the mining. <br />We would be glad to meet with you and project proponents to further <br />clarify our concerns. <br />ag <br />cc: W.
