-6- <br />gmit Condition <br />A reportable spill is a spill of arty toxic ar hazardous substance (including spills of petroleum products) within the <br />mined land permit area reportable to any Division of the Colorado Uepartrnent of Public Health and the Environment, the <br />National Response Center, the Colorndo Emergency Planning Commission, any local Emergency Planning Coaurrission, <br />local Errgency Planning Cortnoit[ee, or the State Oil Inspector. The Mine Operator shall notify the Division of <br />Reclamation, Mining and Safety (DBMS) of a reportable spill within the mined land permit area using the same tirtrefrarne <br />required by the permit, license, notice, statute, mle orregulation governing the reporting of the spill to the other appropriate <br />agency. Notice ofa reportable spill shall be FAXed to: Minerals Program Supe[visor, Division of Reclatretiotr, Mining and <br />Safety, FAX (303) 832-8106. The FAX shall include acall-back cumber of a responsible corrgrany official for DR,MS staff <br />to use as a contact. <br />NOTE TO COMMENTORS/OBJECTORS <br />[t is likely there wilt be additions, chan`ees, and deletions to this document prior to final decision by the Office. Therefore, if you have <br />any comments or concerns you must contact [he applicant or the Office prior to the decision date so that you will know what changes <br />tray have been made to fhe application dnc»menl. <br />The Office is not allowed to consider cortmrents, unless they are written, and rrceived prior to fhe end of the public comment period. <br />You should contact thr appGeant for the final date of the public cortmteni period. <br />Ifyou have questions about the Mined Land Reclamation Board and Office review and decision or appeals process, you «ray contact the <br />Office at (303} g66-3567. <br />
