23. The groundwater wells have been added to the list of structure owners within <br />200' of the affected land. The revised list is attached for your records. <br />24. We are aware that the setbacks depicted on Exhibit C-3 may need to be revised <br />depending on the Divisions review of the Slope Stability Analysis. <br />25. The Applicant currently holds a Contract to Buy and Sell Real Estate on the <br />property, which is contingent upon approval of all necessary land-use permits. <br />Once all appropriate applications are approved the sale of the property will take <br />place. At this time, the Applicant will own the structures on the site. When the <br />purchase is finalized, we will forward evidence of ownership of the structures to <br />the Division for your records. In lieu of the closing on the purchase, the <br />Applicant commits to maintaining these structures until such time that evidence <br />of ownership can be supplied. We respectfully request that the Division approve <br />the permit with this commitment as a condition of approval. <br />26. We await the Division's review of the submitted Slope Stability Analysis for the <br />Heit Mine. <br />I hope that the attachments and the above discussions pertaining to your initial <br />adequacy concerns sufficiently address the Divisions questions regarding this <br />submittal.
