~~ Banks and Gesso, LLC
®®
July 1, 2003
720 Kipling St.,Suite117
Lakewood, Colorado 80215
(303)274-4277
Fax (303)274-8329
www. banksandgesso. com
Division of Minerals and Geology RECEIVED
Attn: Kate Pickford
1313 Sherman Street, Room 215 JUL 0 2 2003
Denver, CO 80203
Division of Minerals and Geology
RE: File M-2003-016; Adequacy Response
Ms. Pickford:
We are in receipt of your adequacy review letter for the above referenced permit
application, dated June 5, 2003. Your concerns are addressed below and follow the
order presented in your letter. Also, please be aware that the Applicant wishes to
withdraw the option to mine the 7-acre area in the northwest corner of the property.
Revised and signed maps depicting this change have been attached. The discussions
below reflect this change where applicable.
1. The proof of mailings for the notifications can be found in the attached envelope
labeled "Proof of Mailings".
2. The revised maps have been signed by Mr. Paul T. Banks, a professional
geologist and principal of Banks and Gesso, LLC.
3. The Applicant will follow the Hazardous Waste Management Plan, which has
been prepared for this site and is attached for your review.
4. It is our understanding that Rule 6.3.3(g) applies only to DMG 110 and 111
permits and that this information is not required for DMG Regular 112 permits. If
our understanding is incorrect, please let me know so that we can properly
address this concern. In general, only one internal haul road will be of a semi-
permanent nature. That haul road will be the one used for trucks entering and
exiting the plant area. The road is identified on Exhibit C-3 Mine Plan Map. It will
be approximately 20 feet in width and will be constructed of compacted dirt and,
where necessary, possibly crush and run gravel. Per county requirements, the
access road will also be paved for a distance of approximately 200' from the site
entrance towards the processing area and scale house. All other internal haul
roads will be temporary and will be relocated and mined through as conditions
merit.
5. Topsoil will be stockpiled separately from overburden. Exhibit C-3 Mine Plan
Map indicates the locations of the separate stockpiles. Much of the topsoil will be
"stockpiled" in temporary screening berms located around mine phase
boundaries. Overburden will be stockpiled in the northwestern corner of the
property until it can later be used in reclamation efforts.
