<br />APPENDIX B • <br />SUMMARY OF PERTINENT FEDERAL AND STATE LEGISLATION <br />A. FEDERAL LEGISLAT]ON <br />During the past century, a developing concern for historic pre- <br />servation has resulted in a multitude of statutes and governing regulations. <br />The foundation for preservation was established with the Antiquities Act of <br />1906. This initial act provides Federal land-managing agencies with a basis <br />for prosecuting private collectors and vandals and with an accessory audit on <br />contracted archaeological work undertaken by land users in order to comply <br />with planning statutes. In addition, the Antiquities Act provides the <br />Federal government, through its permit program, with a means of safeguarding <br />the quality of basic archaeological research. <br />The National Historic Preservation Act ~NHPA) of 1966 established <br />the Department of Interior-Advisory Council-State relationship and gave the <br />Secretary some direction. The National Register of Historic Places ~NRHP) <br />and the Advisory Council on Historic Preservation were established. Federal • <br />agencies were directed to consult with the council before adversely affecting <br />National Register property. <br />Executive Order CEO) 11593 was signed by President Nixon in 1971. <br />This order directed Federal agencies to identify properties eligible for <br />nomination to the NRHP and also required that precautions be taken to avoid <br />damage to potentially eligible sites. In 1976, this aspect of the order was <br />incorporated into the 1966 act by amendment to Section 106. Federal agencies <br />must now consult with the council whenever they may adversely affect a <br />potential or real NRHP site. <br />The National Environmental Policy Act ~NEPA) of 1969 requires <br />Federal agencies to appraise the impacts of their activities on the environ- <br />ment during planning phases. NEPA, thusly, supplies a mandate for federal <br />agencies to identify and plan for the protection of prehistoric and historic <br />cultural resources, as a part of their overall project-planning and land- • <br />management programs. <br />B-1 sclenas su~rlcas d1~lsion <br />
