Third Park Federal Coal Exploration License Environmental Assessment <br />Environmental Consequences/Mitigation: There is potential for disturbance to migratory birds <br />during drilling, access, and site reclamation including direct effects to unidentified active nests, potential <br />mortalities and injuries to birds and eggs in unidentified nests, and disturbance to suitable nesting habitat <br />potentially resulting in incidental "take" of migratory birds. The effects associated with the Proposed <br />Action would be limited in time to the summer/fall of 2007, and are not expected to have a lasting effect <br />to locally nesting bird populations. A biological field survey of the project area conducted in May 2007 <br />reported observations of several migratory birds; however, no active migratory bird nests were found <br />within or near proposed drill sites and overland access routes (ARCAD[S 20076). If active migratory bird <br />nests are identified during project implementation, appropriate measures would be taken to reduce effects <br />to these species including relocating overland access routes and drill hole locations and implementing <br />disturbance-free buffer zones and timing limitations for active raptor nests. <br />Under the No Action Alternative, there would be no new effects to migratory birds. <br />NATIVE AMERICAN RELIGIOUS CONCERNS <br />Affected Environment: Traditional cultural properties are associated with cultural practices or <br />beliefs of a living community that are rooted in the history of the community and are important in <br />maintaining the continuing cultural identity of the community. The Class [I[ cultural resource inventory <br />conducted by ARCADIS in 2006 did not identify any traditional cultural properties in the Project Area. <br />Environmental Consequences/Mitigation: Implementation of the Proposed Action would likely <br />have no effect on Native American religious concems or traditional cultural properties. <br />Under the No Action Alternative, there would be no effects to Native American religious concerns. <br />THREATENED, ENDANGERED, AND SENSITIVE SPECIES (includes a finding on Standard 4) <br />Affected Environment The Montrose County threatened and endangered species list was <br />obtained from the USFWS website and is included in Table 3 (USFWS 2006). Distribution, occurrence, <br />and habitat information was obtained from Kingery (1998), Fitzgerald et al.
