Box 1966 <br />Rifle, Colorado 81650 <br />Dear Mr. Kriz: <br />On January 17, 1978, I discussed the matter concerning your assumption <br />of the White River Aggregates operation conducted under the Department of <br />Highways t,DOH) option with the landowner. There appears to be two vital <br />points controlling what may be done. <br />First, if any material is removed from the DOH portion of the operatioh <br />for use in work you may be performing which is not a highway project you <br />should have full permission from the DOH. Their pits are set up for their <br />projects and usually are not utilized by the contractor or other persons <br />for materials needed in other construction without either full permission <br />from the DOH, or a succession of operator. <br />Second, if you desire to asstune this operation but operate your private <br />operation under the DOH permit you must understand that any violations which <br />might occur will cause the DOH to be the responsible party, a situation <br />they may well not desire to involve themselves. Violations on their <br />operations can have very serious consequences to the DOH due to the fact <br />that until the violation is rectified they cannot receive permits on any <br />new operations. They must use all precautions to prevent such a situation. <br />My advice to you is if you desire to assume operations tinder the D(ki permit <br />then a specifically identified area be set aside strictly for a highway <br />materials source to which their pereoit applies. Areas for your private <br />operations should be conducted under a separate permit held by the private <br />company. I realize this means alot of work, but if the serious legal <br />problems are to be avoided it appears to us the operational areas must be <br />kept separate. <br />In summary, if you are assuming the White River Aggregates operation under <br />the DOH permit for primarily private operations (Mountain Mobil Mix or <br />some other name) we will not recommetrd approval without either a clear <br />seperatiort of DOH arena frog yoaxs and separate permitting, or a statement <br />fro® the DOH that they will be allowing you to conduct private operations <br />under their permit and that they will be responsible for insuring the <br />
