Further to your request for information regarding WYCO's requirements providing
for Cooley Gravel Company's sand/gravel excavations near our pipeline, the
following is offered.
WYCO's Steve l3ernicky has reviewed your proposal and is in'agreement with the
excavations, provided the ovdner of record for the land agrees to the conditions
outlined.
1. There sha!I be no excavations and mining activities any nearer than 50' to
the centerline of our pipeline. WYCO personnel should be contacted at
303-286-6401 to request the centerline field location and to gauge the
depth of the pipeline in this area.
2. All mining activities shall be conducted in a manner which provides a
minimum of a 3:1 slope from the 50' set-back limitation from our pipeline,

maintain stable ground with the 3:1 slope.
3. All wall of embankment resulting from the 3:1 slope shall be rip-rapped,
vegetated, or protected in other suitable methods to eliminate erosion, as
approved by WYCO.
4. There shall be no dynamiting in this area without approval from WYCO.
5. None of the existing cover from WYCO's right-of-way area shall be
removed. Should any access roads be proposed within the right=of-way
area, Cooley Gravel Company shall provide detailed plans for such, and
shall be responsible for undertaking all reasonable measures to protect our
pipeline, as directed by WYCO.
