Box 44 <br />Silver ton, Colorado 81433 <br />RE: Permit Application - Continuance <br />File 1182-11, "Hillyer Pit" <br />Dear Mr. Hillyer: <br />I want to take this opportunity to explain the difficulty that arose <br />March 24, 1982 during the Board consideration of the permit application <br />referenced above. Your attorney's office requested that consideration <br />of the application be continued until the April 21-22, 1982 meeting; <br />this request was made by telephone, Pfarch 24, 1982. <br />The Board raised the following concerns which the application does not <br />adequately address: <br />1. no reclamation plan is included in the application; <br />2. the statement that "no lakes will be created" and the cross- <br />section showing a 21' excavation appear to contradict each other; and <br />3. if the river fails to recharge the available gravel resource, <br />or only a fraction thereof, how will the mining operation be affected? <br />I suggested that these concerns were fairly well covered by the three (3) <br />stipulations we discussed at noon March 24, 1982, but the concensus of <br />the Board members was a preference that you incorporate these items <br />directly into the application. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
