If the area was compacted it <br />would be almost impossible to revegetate the area to the proposed final <br />land use. If the financial warranty has not been released and the <br />proposed final land use changes from pasture to housing, the operator <br />would have to submit an amendment to its permit to allow for this change. <br />10. Page 2, question 5 - The approved financial warranty for this site <br />was set by the Board at $99,000 for a maximum land disturbance at any one <br />time of 51.69 acres. This breaks down to $1,716.OU per acre. <br />11. Page 2, Question 6 - The law (specifically C.R.S. ]973, <br />34-32-116(1)(f)) addresses the requirements for reveyetating the area <br />hack to the cover amount similar to surrounding areas. The Division has <br />no jurisdictio Z authority to specify the density requirements for a <br />reclaimed area. <br />12. Page 2, Question 7 - The Division has no jurisdictional authority <br />in this area. <br />13. Page 2, Question 8 - Exhibit F incorrectly specified slope <br />gradient. The slopes will be graded to no steeper than 4h;l v. <br />The Division hopes this letter clarifies both the reason the permit was <br />issued prior to the initial notice date and the concerns/comments <br />addressed in the City of Lakewood's letter.
