" <br />The End Use given in the county application should match the End Use being approved <br />by the state Reclamation Permit. I would ask that as a condition for granting any permit <br />for this mining operation, the Division of Minerals and Geology require that the End Use <br />be limited to open bodies of water, agriculture, and rangeland, and that the End Use not <br />include limited residential development. <br />C. Maximum Groundwater Impact. The applicant states on page six of the <br />CDMG 112 Permit application that: "To minimize groundwater impacts on the adjoining <br />properties, the Applicant will dewater the future basin areas throughout the course of the <br />mining operations." Such a program will in fact maximize negative impacts by <br />maintaining the dewatered state for the maximum period of time. <br />D. Dewatering Method Inadequately Described. The dewatering method is <br />inadequately described. Data regarding proposed dewatering should be provided, <br />specifically anticipated pumping volumes, anticipated effects on groundwater resources <br />of adjacent properties, and expected groundwater recovery time after termination of <br />operations. Data should be substantiated by a hydrogeologic study with pump test data to <br />support the hypotheses. <br />In conclusion, if the Boazd approves this application, I will be exposed to potential loss <br />and injury to my legitimate interests, including but not limited to business, economic, <br />governmental, recreational, and conservational interests. Therefore, I ask to be made a <br />fuii Parry to this matter before the Boazd. In addition, I ask that the Board consider the <br />above mentioned concerns at the final hearing. Finally, in light ofthese issues, I believe <br />the application is inadequate to meet the requirements of the Construction Materials Act, <br />C.R.S. § 34-32.5-101.
