Colfax, Ste. 350 <br />Lakewood, CO 80215 <br />/ / / ,/ <br />Re: Coulson Excavating Company, Int.'s Stroh Pit, File No. M-2002-078, Incomplete 112 <br />Construction Materials Reclamation Permit Application Package <br />Dear Mr. Wayland: <br />On July 19, 2002, the Division of Minerals and Geology received your 112 Construction Materials <br />Reclamation Permit Application package for the Stroh Pit, File No. M-2002-078. Preliminary review of the <br />information received determined that the following items must be received before the Division can consider your <br />application as being submitted and technical review can begin: <br />EXHIBIT N -Source of Lesal Ri¢ht to Enter (Rule 6.4.141: You must provide the source of your <br />legal right to enter and initiate a mining operation on the affected land. Please submit a copy of access <br />lease, deed, abstract oftitle, or a current tax receipt. <br />EXHIBIT S -Permanent Man-Made Structures (Rule 6.4.191: You must provide information <br />sufficient to demonstrate that the stability of any structures located within two hundred (200) feet of the <br />operation or affected land will not be adversely affected. Please provide: <br />(a) a notarized agreement between the applicant and the person(s) having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) ~=here such ar. agreement can r.~ be reached, t„e applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities <br />occurring at the mining operation. <br />(c) where such structure is a utility, the Applica~ may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, will <br />have "no negative effect" on their utility. <br />The document submitted from Kaneb Pipeline Company is not signed by Coulson Excavating <br />Company, htc. You must submit either a, b, or c above for the house located 50 to 75 feet from the <br />excavation area and the Hillsboro Ditch, which is 87 feet from the permit boundary. <br />
