We certainly share your concern <br />about any potential impacts on water quality or quantity. <br />A review of the permit application shows that the proposed pit area is 6.8 <br />acres. The applicant has stated that no water will be used in the operation <br />and that no ground water will be encountered or disturbed. <br />We have also contacted the U.S. Army Corps of Engineers. They have responded <br />by stating that the proposed activity will not require a permit from them. We <br />have also contacted the Urban Drainage and Flood Control District. They have <br />determined that the Droject location is not within the jurisdictional limits <br />of their District. Therefore we do not believe that vre can deny this permit <br />based on any possible impacts on water quality or quantity. <br />Mr. Mitchell has requested that we continue our decision on his permit <br />application until December 21, 1990. <br />If you wish to contest this permit application any further you must write us <br />and request a formal public hearing before the Mined Land Reclamation Board. <br />This request must be received before January 20, 1991. <br />If you have any further questions or comments please feel free to contact me. <br />Sincerely, <br />u <br />Gregg R.
