<br />ii, The pennittee must, by llecember 31, 2008, submit a progress report summarizing the efforts undertaken by the
<br />permittee for a site specific ]imitation for total recoverable iron, in regards to the WQCC hearing for the Upper
<br />Colorado River Basin, as well as the WQCC decision from the mlemaki~tg hearing in June 2008.

<br />iii. The permittee must, by September 30, 2008, s Submit to the Division an amendment request for either updating the
<br />limitatiar for total recoverable iron based upon a site specific standard (if approved by the WQCC), or for additional
<br />time to meat the ]imitation which currently takes effect on Jmmary 1, 20(19,.
<br />Upon approval of the implementation plan by [he Division, all ternts and conditions of the implementation plan, including
<br />bn[ not limited to the compliance schedule, will automatically become conditions of this permit.
<br />6. Chrmtic WF.T Testing -- Outfalls R'TA ,WTB, WTC, WTD, WTE, WTF, WTG, WTH, WTI
<br />a. Testing and Reporting Requirements
<br />Tests shalt be done at the frequency listed in Part LB. t. Test resuhs shall be reported on the Discharge Monitoring
<br />Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., WET testing results for the
<br />first calendar quarter ending March 31 shall be reported with the DMR due April 28 J The results shall be submitted on
<br />the Chronic Toxicity Test report form, available from [he Division. Copies oFthese reports are to be submitted to both
<br />the Division and EPA along with the DNIR.
<br />The permittee shall conduct each chronic WET test in general accordance with methods described Short Term Methods
<br />for Estimating the Chronic Toxicity of Effluents and Receiving Waters [o Freshwater Or anQ isms, EPA/600/4-89/001 or
<br />the most current edition, except as modified by the most current Division guidance document entitled Guidelines for
<br />Conducting Whole Effluent Toxicity Tests. The permittee shall conduct such tests using Ceriodaphnia dubia and fathe.
<br />minnows. ~.
<br />Alternative Test Method As the discharges from this facility are occasionally, "intermittent discharges", an alternative
<br />method for sample collection during WET testing may he needed. The pennittee shall collect all needed samples (3) for
<br />WET testing on the same day, and store them for firmre use, if it becomes necessary. If the discharge continues to flow
<br />on the days that the subsequent samples would normally have been collected, the pennittee shall collect [he sample in
<br />accordance with the EPA guidance document. If the discharge flow has ceased; the pennittee shall use the stored
<br />samples and ship them to the laboratory as needed. The permittee shall follovr the WET sampling guidance found in
<br />EPA document EPA-600-4-91-002 when ever possible.
<br />b. Failure of Test and Division iVotiticatinn
<br />Outfalls WTB (Outfall 004) and WTE (Outfall 008) -Beginning oh the effective date of this permit, a chronic WET
<br />test is failed whenever there is a statistically significant difference in lethality lxtween the control and any effluent
<br />concentration less than or equal to the instream waste concentration ("IWC"). The IWC for all outfalls has been .
<br />determined to be 100%. The pennittee must provide written notitication of [hr. failure of a WET [es[ to [he Division,
<br />along with a statement as to whether a Preliminary Toxicity Investigation ("P77~:)/Toxicity Idemification Evaluation
<br />("TIE") or accelerated testing is being performed. Notification must be received by the Division within 2I calendar
<br />days of the demonstration of chronic WET in the routine required test. "Demonstration" For the purposes of
<br />subparts b.. c., d., e. and g. means no later than the last day of the laboratory test.
<br />Outfulls WTA (outfalls 00? and 003), Outfall WTC (Outfall 0051, Outfall WTD (Ouifall 006), Ou[fall WTF
<br />(Outfall 0l0), Outfall WTG (Outfall Oll), and Outfall WTI (Outfall 016 and 017) -Beginning on the effective date
<br />of the (imitation (January 1, 2008) a chronic WE'f test is failed whenever there is a statistically significant difference in
<br />lethality between the control and any effluent concentration less than or equal to the instream waste concentration
<br />("IWC"). The IWC for these outfalls has been determined to be 100%. The permittee must provide written notitication
<br />of the failm e of a W ET test to the Division, along with a statement as to whether a Preliminary Toxicity Investigation •
<br />("PTI")/Toxicity Identification Evaluation (""CIE") or accelerated testing is being perforated. Notification most be
<br />received by the Division within 21 calendar days of the demonstration of chronic ~VFT in the routine required
<br />test. "Demonstration" for the purposes of subparts b., c., d., e. and g. means nit later than the last day of the laboratory
<br />test. Prior to the limitation becoming effective, the pennittee is to monitor and report the WET test results for these
<br />outfalls.
