We have determined that NIr. Stone's activities <br />have not resulted in a possible violation of the Construction Materials Act and Rules and <br />Regulations and have, therefore, withdrawn the issue from hearing before the Colorado Mined <br />Land Reclamation Board. <br />Attached, is a copy of DMG's January 26, 1998 letter to NIr. Stone, addressing the withdrawal of <br />the enforcement action, and copy of DMG's December 22, 1997 Reason to Believe A Violation <br />Exists, now withdrawn. <br />For your information, you have the right to ask that this matter be brought before the Board. <br />Therefore, ifyou would like for the Board to consider this issue or require further information or <br />assistance, please contact Wally Erickson at the DMG Durango Office, 484 Turner Drive, Building <br />F, Suite 101, Durango, Colorado, 81301; telephone (970) 247-5469. At your request, NIr. Erickson <br />will have the matter scheduled to be heard before the Board.
